I owed $80,000 on student loans. I receive SSDI and long-term disability checks. My student loans have been in forbearance for 10 years. Can my SSDI or long-term disability checks be garnished if they go into default?

Answer:

The IRS can garnish SSDI benefits without the debtor’s consent. However, the IRS can only garnish up to 15% per month. SSI benefits cannot be garnished.
